This User Agreement ("Agreement") outlines the terms and conditions under which Junky Travels LLP ("SYOLO TRAVEL") provides services to individuals or entities ("User") who wish to purchase or inquire about SYOLO TRAVEL's goods and/or services. This Agreement applies to all interactions with SYOLO TRAVEL, including through its website, mobile applications, and other customer interface channels. The User and SYOLO TRAVEL are collectively referred to as "Parties" and individually as "Party."
1. Application of the Agreement
This Agreement governs the provision of services by TRAVEL JUNKY to the User. By using TRAVEL JUNKY's services, the User acknowledges having read, understood, and agreed to the terms and conditions outlined herein. These terms are binding on the User for all transactions or services provided by TRAVEL JUNKY. TRAVEL JUNKY reserves the right to modify, suspend, or terminate access to its websites, sales channels, or services at any time, without prior notice, for maintenance or other reasons.
2. Additional Terms of Service (TOS)
In addition to this Agreement, specific terms of service (TOS) may apply to SYOLO TRAVEL's products and services, such as vacation packages, airline tickets, and other travel-related offerings. These TOS, provided and updated by SYOLO TRAVEL, form an integral part of this Agreement. In case of any conflict between the TOS and this Agreement, the terms of this Agreement shall prevail. The User is responsible for reviewing and accepting the applicable TOS for the product or service they are using. Additionally, service providers (e.g., airlines, hotels) may have their own terms, conditions, and rules, which the User must comply with.
3. User’s Acceptance of Terms
By using SYOLO TRAVEL's services, the User agrees to abide by all terms, conditions, and notices outlined in this Agreement and the applicable TOS, as updated from time to time. If the User disagrees with any part of these terms, they must refrain from using SYOLO TRAVEL's services. In the event of any conflict between the terms of this Agreement and any other SYOLO TRAVEL document, the terms of this Agreement shall take precedence.
4. Third-Party Account Information
The User authorizes SYOLO TRAVEL to access and retrieve information from third-party accounts (e.g., banks, payment gateways) as necessary to provide the requested services. SYOLO TRAVEL is not liable for any unauthorized use of the User's account or password, whether with or without the User's knowledge. The User is responsible for maintaining the confidentiality of their account credentials.
5. Confidentiality
The User agrees to maintain the confidentiality of any information designated as confidential by SYOLO TRAVEL. Such information shall not be disclosed unless required by law, to fulfill the terms of this Agreement, or to meet the obligations of the Parties.
6. Use of Website and Mobile Applications
The User acknowledges that the use of SYOLO TRAVEL's website and mobile applications is at their own risk. SYOLO TRAVEL is not liable for any inaccuracies, errors, or omissions in the content provided. The User is responsible for ensuring that the products, services, or information accessed through SYOLO TRAVEL meet their specific requirements. The User is prohibited from modifying, copying, distributing, transmitting, reproducing, publishing, licensing, or selling any content, software, products, or services obtained from SYOLO TRAVEL's website or applications. SYOLO TRAVEL reserves the right to modify, amend, or remove any content without prior notice.
7. Use of User’s Mobile Number
SYOLO TRAVEL may use the User's mobile number to send booking confirmations, itinerary details, payment confirmations, refund status updates, schedule changes, and other transaction-related information via SMS, voice call, or email. The User consents to such communications, which are considered transactional and not unsolicited commercial communication under applicable regulations. The User agrees to indemnify SYOLO TRAVEL against any losses or damages arising from incorrect complaints or the provision of false contact information.
8. User’s Responsibilities
The User is solely responsible for the accuracy of their data and bookings. SYOLO TRAVEL does not screen or verify the legality or validity of transactions under the User's jurisdiction. The User must comply with all applicable laws, regulations, and guidelines related to the use of SYOLO TRAVEL's services.
9. Insurance
Unless explicitly provided by SYOLO TRAVEL as part of a service or product, the User is responsible for obtaining adequate insurance coverage. If insurance is offered by SYOLO TRAVEL, it is subject to the terms and conditions of the insurance provider. SYOLO TRAVEL does not guarantee the acceptance of claims by the insurance provider.
10. Force Majeure
SYOLO TRAVEL is not liable for situations beyond its control, such as natural disasters, labor disputes, bankruptcy, operational issues, or other force majeure events that may result in the cancellation or modification of bookings. In such cases, SYOLO TRAVEL will endeavor to provide alternative arrangements or refunds, subject to the policies of the service providers.
11. Limitation of Liability
SYOLO TRAVEL's liability is limited to the amount paid by the User for the services, less any applicable fees. SYOLO TRAVEL is not liable for any indirect, incidental, special, or consequential damages arising from the use of its services or website.
12. Indemnification
The User agrees to indemnify and hold SYOLO TRAVEL harmless from any claims, losses, damages, or expenses arising from their use of the services, violation of this Agreement, or infringement of third-party rights
13. Termination of Services
SYOLO TRAVEL reserves the right to refuse or cancel any order or terminate the User's access to its services at its sole discretion, without prior notice. This includes situations where the User violates this Agreement, provides inaccurate information, or engages in fraudulent activities.
14. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15. Governing Law
This Agreement is governed by the laws of [Insert Jurisdiction]. Any disputes shall be subject to the exclusive jurisdiction of the courts located in [Insert City/Region], India.
16. Amendments
SYOLO TRAVEL reserves the right to modify this Agreement, including fees and terms of service, at any time without prior notice. The User is responsible for regularly reviewing the terms and conditions.
17. Use of Customer Content
SYOLO TRAVEL may use images, videos, or other content shared by Users for promotional purposes on social media platforms. Users who do not wish their content to be used may contact SYOLO TRAVEL at info@syolotravel.com
